These Terms of Use govern your use of centercc.com (the “Site”), operated by the Center for Cognition and Compassion (“CCC”, “we”, “us”). By using the Site you agree to these terms. If you do not agree, please do not use the Site. You must be 18 or older to use the Site.

Information only — not professional advice

The Site, including articles, classes, inventories, questionnaires and their results, is provided for general education and information. It is not medical, psychological, legal or other professional advice, diagnosis or treatment, and it is not a substitute for an evaluation by a qualified professional. Inventory results are not a diagnosis. Always seek the advice of a licensed clinician about any question regarding your health or a child’s development.

Emergencies

Do not use this Site or its forms for emergencies. If you or someone else is in danger, call 911. For a mental health crisis, call or text 988 (Suicide & Crisis Lifeline), available 24/7.

No provider–patient relationship

Using the Site, completing an inventory, attending a free class or sending us a message does not create a psychologist–patient or other professional relationship. A professional relationship exists only for people who are actual clients of the clinic, after we agree to provide services and complete our intake and consent process.

Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, submitting malicious code, sending spam through our forms, or using the Site in violation of any law. Access to professional tools on the Site is limited to authorized users.

Content you send us

If you submit or upload anything to the Site, you confirm that you have the right to do so and that it does not infringe anyone else’s rights.

Intellectual property

Unless otherwise noted, all content on the Site — including text, inventories, item wording, scoring methods, graphics, logos, course materials and software — is © Center for Cognition and Compassion and is protected by copyright and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, modify, distribute, republish, sell or create derivative works from Site content without our prior written permission. Third-party names and trademarks belong to their owners.

Copyright complaints (DMCA)

Notice. If you believe content on the Site infringes your copyright, send our agent a written notice that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material you claim is infringing and where it appears on the Site; (4) your name, address, phone number and email; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law; and (6) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.

Counter-notice. If material you posted was removed and you believe that was a mistake or misidentification, you may send our agent a counter-notice that includes: (1) your physical or electronic signature; (2) identification of the material removed and where it appeared; (3) a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (4) your name, address and phone number and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which we may be found) and will accept service from the person who sent the original notice. We may restore the material 10 to 14 business days after receiving a valid counter-notice unless the complainant tells us it has filed a court action.

Repeat infringers. We will, in appropriate circumstances, end the access of users who repeatedly infringe copyrights.

Purchases and refunds

Purchases made through the Site are one-time payments, processed by PayPal or Stripe under their own terms, and are subject to our Refund & Cancellation Policy.

Links to other sites

The Site may link to websites we do not control. We are not responsible for their content or practices.

Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CCC AND ITS CLINICIANS, STAFF AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH THE SITE IN THE 12 MONTHS BEFORE THE CLAIM OR US $100.

Nothing in these terms limits or excludes liability for fraud, willful injury to a person or property, or violation of law (California Civil Code §1668), or any liability that cannot be limited by law. Nothing in these terms waives your rights under the California Consumers Legal Remedies Act or other consumer protection laws. Professional services to clinic clients are governed by separate agreements and applicable law, not by this section.

Indemnity

To the extent permitted by law, you agree to indemnify CCC against third-party claims arising from your misuse of the Site or your violation of these terms.

Governing law and venue

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to the Site will be brought in the state or federal courts located in California.

Changes

We may update these terms by posting a new version on this page with a new “Last updated” date. For material changes we will also notify people whose email address we have. Continued use of the Site after a change takes effect means you accept the updated terms.

Severability and entire agreement

If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with our Privacy Policy and Refund & Cancellation Policy, are the entire agreement between you and us about use of the Site. Any separate written agreement for clinical or professional services controls for those services.
